1. The collection and use of physical activity and health data will be carried out and processed for the following purposes, which are detailed below

1.1. Our Mobile App accesses and uses your smartphone's health data to provide features involving:

• Reading step data (stepdata): to display information about your physical activity.
• Writing step data (stepdata): to record physical activities as defined and configured by you on your equipment.

The accessed data is used exclusively for the purposes mentioned above and is not shared with third parties without your consent.

1.2. User Consent

Access to health data is only with your explicit consent, as required by the device's read and write permissions.

1.3. Data Storage and Protection

The data collected and/or written by the application is stored locally on the device and is not transferred to external servers. We implement security measures to protect your data against unauthorized access or misuse.

1.4. Data Sharing

We do not share, sell or disclose your steps data collected on the device with third parties.

1.5. User Rights

You can revoke the permissions granted to the app at any time directly in your device's settings.

1.6. Changes to Privacy Policy

We reserve the right to update this Privacy Policy at any time. We will notify users about significant changes through in-app updates or other appropriate means.

 

2. For what purpose and on what legal basis do we process your personal data?

2.1. Personal data will be collected and processed for the following purposes, which are detailed below:

Manage and maintain the contractual relationship from the moment the order is placed until said relationship ends, including checking that the order placed by him is registered and delivered properly, carrying out communications related to the provision of services that are necessary, as well as the managing customer information service inquiries and complaints.

2.2. Legitimate interest:

Carry out commercial and/or advertising communications, including electronically, with the purpose of keeping you informed about products and services similar to those in the contract, notably discounts and promotions.

2.3. Compliance with legal obligation:

Communicate information to public authorities or government bodies in cases where such communication is required by law.

If you authorize it, your data will still be used to keep you informed, including electronically, about the products and services sold by Clínica Médica Dr. Tallon, Lda and by development company UltraWise, Lda, allowing you to participate in competitions and promotions, as well as knowing your level of satisfaction in order to improve and develop products and services in accordance with your needs and interests.

Clínica Médica Dr. Tallon, Lda and development company UltraWise, Lda may communicate your personal data to the following entities:

3.1. Public authorities under the terms set out in section 2.3 of point 2.

 

4. Storage of your personal data

4.1. Your personal data will be processed and maintained by Clínica Médica Dr. Tallon, Lda and by development company UltraWise, Lda, throughout the duration of the contractual relationship with you. The criteria used to establish the retention periods for your data were determined in accordance with the criteria established in applicable legislation, regulations and guidelines, as well as operational requirements related to the correct management of relationships with our customers.

4.2. Notwithstanding the provisions above, your data will be kept duly blocked, for the duration corresponding to the existence of responsibilities of any nature, as well as to comply with other legal obligations. In these cases, we guarantee that your data will not be processed, unless such processing is necessary for the formulation, exercise or defense of claims or when it is necessary to provide it to Public Authorities.

 

5. Your rights

You may exercise your rights of access, rectification, data deletion, cancellation and opposition, as well as the right to limit the processing and portability of your personal data, confirming your identity (upon presentation of a valid identification document) before:

6. Criteria for Data Deletion

Personal and health data will be deleted in the following situations:

6.1. When the purpose for which they were collected or processed has been achieved and there is no legal or legitimate need for their retention.

6.2. Upon request from the data subject, except when retention is required by law or to fulfill contractual obligations.

6.3. When they are identified as unnecessary, excessive or treated in violation of applicable legislation.

 

7. Data Deletion Procedures

7.1. Data deletion will be carried out using secure and irreversible methods, including, but not limited to:

• Permanent deletion of digital databases.
• Physical destruction of printed documents containing personal data.

7.2. The deletion will be recorded in a report containing a description of the deleted data, the date and the method used.

 

8. Complaints

If you consider that Clínica Médica Dr. Tallon, Lda or UltraWise, Lda, has infringed any of the aforementioned rights, you will also have the right to lodge a complaint with the National Data Protection Commission.
